Barry J. Bernstein
Attorney at Law
Barry J. Bernstein is an accomplished attorney and military veteran. With over four decades of experience, he has served in various high-level governmental positions. Most recently he served as Deputy Attorney General of South Carolina, where he also served as Chief of Staff. He has served as a representative to the Governor's Task Force on Cybersecurity, a proxy on the Law Enforcement Training Council, SC representative on the National Attorneys General Training and Research Institute and chairman of the state Prosecutor’s Review Committee. Before retirement, he successfully led the agency through its first legislative oversight review before the SC House of Representatives.
His military career began modestly as a private and culminated in his retirement as a colonel with 34 years of military service. He started as a private in the 1/118th Infantry before being commissioned as a Military Intelligence officer on active duty, and finishing the last 15 years of his career as a JAG officer. Colonel Bernstein was responsible for developing the largest Army National Guard judge advocate corps in the nation. His overseas service includes Iraq and Korea. Barry’s international military and legal work includes deploying to Baghdad as part of the Multi-National Security Transition Command-Iraq, where one of his duties was coordinating training for Islamic military judges. Colonel Bernstein’s military diplomas include the Command and General Staff College, Signal School, Military Intelligence School, and the Judge Advocate General School.
Barry's civilian education is equally compelling. He holds a Juris Doctor degree from the University of South Carolina School of Law, where his graduating class selected him for the only peer evaluated award (recognizing integrity, industry and leadership). He also holds a Bachelor's degree from the University of South Carolina where he was named Outstanding Senior. He has taught Continuing Legal Education classes in state for the SC Bar and nationally for National Association of Attorneys General.
Upon retirement from the military and state government, in 2022 he established the Bernstein Law Firm, LLC. He has a general practice for clients locally and sustains a statewide practice for issues of the military and state government. He is outcome focused, and guides clients to the desired result, with a clear intent to preclude trivial issues or additional litigation.
Barry has been recognized for his contributions to the legal field and military. Barry has been awarded the Legion of Merit, Bronze Star, and 20 other military decorations. Additionally in the military, he was honored with the National Guard Association of SC President's Award, the artillery's Order of St. Barbara, and the state "Junior Officer of the Year" award by the Reserve Officer's Association. He has been named in Who’s Who publications for the Law, In America, and in the World. Barry also twice served as chair of the SC Bar Military and Veterans Law section.
Barry and his wife, Diane, are almost empty nester's living at Lake Murray. He is a father, step-father, and foster parent. When not at the office, he spends his time swimming and following Gamecock sports.
